Terms and Conditions
ORGANIZER
The organizer and responsible party for the implementation of the competition is Raschke Entertainment GmbH, Kronberger Str. 10, 14193 Berlin.
1. PARTICIPATION
You can enter the prize draw if you are a resident with a valid postal address in Germany (Austria or Switzerland) and you are at least 18 years old. Employees of the publishing house, dealers, sponsors, and distributors, as well as anyone involved in the execution of the prize draw, are excluded. This also applies to relatives of the aforementioned individuals.
By participating in the sweepstakes, you expressly agree to the contents of these terms and conditions.
Participation in the prize draw is of course neither associated with costs nor do you have to purchase any goods or services.
To give everyone the same chance of winning, you can only participate once. Using multiple accounts to increase your chances of winning is not permitted. The same applies to participation via sweepstakes services, automated mass participation procedures by third parties, via agencies, or via other commercial providers.
The profit is neither exchangeable nor transferable. Cash payment is excluded.
The sweepstakes is in no way sponsored, endorsed, or administered by, or associated with Instagram/Facebook. Legal recourse is excluded. Participants in the sweepstakes shall not have any claims against Instagram/Facebook arising from their participation.
2. DETERMINATION OF WINNERS
You're probably wondering how the winners are chosen: they will be randomly selected from all participants after the contest period ends and notified via private message to the participating account (Instagram / Facebook). We do not publicly disclose the names of the winners.
The prizes will then be sent to the mailing address or email address you provide to us within seven (7) days of receiving the prize notification, unless we have specified otherwise in the prize notification.
If you do not provide us with your complete postal address/email address within seven (7) days of us sending the winner notification, we unfortunately cannot deliver the prize to you. In this case, we will not hold onto the prize. Instead, the claim to the prize will expire, and we will draw a replacement winner from the remaining participants. This also applies if you do provide us with an address, but you do not accept the prize within seven (7) days of the winner notification being sent, or if the prize is returned by the shipping service provider, e.g., due to an incorrect/incomplete address or non-collection.
Delivery is not guaranteed. Redelivery in case of non-delivery is not provided.
So that we can properly process the giveaway, we need your correct contact details. If the prize cannot be assigned correctly due to incorrect data, your claim to the prize will be forfeited. The prize is neither exchangeable nor transferable. Cash payout is excluded. The responsibility for any taxation of the prize lies with you.
We want to ensure that the prize draw is conducted fairly. We therefore reserve the right to exclude participants who violate the terms and conditions or attempt to influence the prize draw through technical manipulation. In the event of exclusion from the prize draw, prizes may subsequently be revoked and reclaimed.
If the prize cannot be provided for reasons not represented by the publisher/agency, we reserve the right to deliver an equivalent replacement. Shipment of the prize will only be made within Germany, Austria, and Switzerland. Upon handover to the shipping service provider, the risk of accidental loss and accidental deterioration passes to the prize winner.
3. DATA PRIVACY
The data collected as part of the prize draw will be processed and stored for the purpose of conducting the prize draw, and will be deleted after the prize draw has ended and the prize has been redeemed.
Provided data will not be shared with third parties.
Questions, suggestions, and complaints should be directed exclusively to the person in charge via email at info[at]raschke-entertainment.de.
4. LIABILITY
We are not liable for any technical or other issues that arise during the execution of the prize draw that are beyond our control.
We are liable only for damages for which the responsible party is guilty of intent or gross negligence, according to legal provisions.
Damages caused by negligence less than gross negligence will only be compensated if it involves a breach of a material obligation essential for the execution of the sweepstakes. In cases of a breach of such a material obligation with negligence less than gross negligence, the liability of the responsible party is limited to the amount of damage that is typical for comparable constellations of this kind and was foreseeable at the time of the breach of obligation.
Claims for damages under the Product Liability Act and for damages from injury to life, body, or health remain unaffected by the aforementioned limitation of liability.
Liability for data loss or corruption is limited to the expense that would have been incurred to restore the data from the backup if proper data backup procedures had been followed.
The above limitations of liability shall also apply in favor of the legal representatives and vicarious agents of the responsible party.
5. MISCELLANEOUS
The exclusive governing law shall be the law of the Federal Republic of Germany. These terms and conditions constitute the final regulations for the prize draw. Should any of these provisions be or become invalid, the validity of the remaining terms and conditions shall remain unaffected.
The prize draw is subject to German law. Legal action is excluded.
